Noella Christmas 2019 campaign terms and conditions

1. The promoter
1.1 The promoter is Transport of Greater Manchester of 2 Piccadilly Place, Manchester, M1 3BG (“ TfGM ”).
2. The competition
2.1 The title of the competition is “TfGM’s Christmas 2019 ‘Noella the Elf’ Campaign”, which is a campaign launched in connection with TfGM’s Metrolink services and in an attempt to increase TfGM’s engagement with the public through the use of the Metrolink (“ the Campaign ”).
2.2 The competition is in two parts and involves entrants collecting a miniature collectable figure of TfGM’s Christmas ‘Noella the Elf’ (“ Figure ”) or a limited edition golden Figure (“ Golden Noel ”) before uploading a photograph onto social media with their Figure or Golden Noel with the hashtag “#TfGMNoel”.
2.3 Details of where entrants will have the chance to collect a free Figure or Golden Noel are available at, where entrants will be required to solve the riddle to reveal the location of where they can collect a Figure or Golden Noel. Entrants to the competition will have a chance to win a Prize, as well as the opportunity of their photograph being used by TfGM in the Campaign. Individuals who collect a Golden Noel will be entitled to free travel on the Metrolink, as set out in clause 5.3.
3. How to enter
3.1 The competition will run from 06/11/2019 to 19/12/2019 inclusive (“ the Competition Period ”).
3.2 Before being able to participate in the competition, individuals will need to collect a Figure or a Golden Noel. They can be obtained by:
(a) visiting and solving the riddle to reveal a location. These locations will change throughout the Competition Period and there will be 250 Figures available for a limited time at each location. The first 50 individuals who attend each location will be given Golden Noel; or
(b) riding the Metrolink on the 06/11/19 where approximately 2500 Figures will be handed out to passengers at various stops. This will include 100 Golden Noels, which will be handed out to Passengers at random.
3.3 To participate in the competition, entrants will need to upload an original photograph of a Figure or a Golden Noel collected by them onto their personal Facebook, Instagram and/or Twitter social media account(s) whilst using the specified hashtag “#TfGMNoel” in the title or description of the post. Entrants can submit multiple entries during the competition by uploading a different photograph. However, entrants will only receive one entry to the competition for every original photograph they upload (including if they upload the same photograph across multiple social media accounts).
3.4 In submitting a post and entering into the competition, entrants will be deemed to have accepted these terms and conditions.
3.5 Individuals who do not participate in the competition as set out in clause 3.3 but do collect a Figure may keep any Figure(s) collected. Only individuals who participate in the competition, as set out in clause 3.3, will be eligible for a Prize.
3.6 All entries for the competition must be received by TfGM no later than 11:59pm on 18/12/19. Although the campaign may be running after this date, all entries received after this date will be automatically disqualified from the competition and no Prizes will be awarded.
3.7 Entrants to the competition will be judged on an on-going basis and the winners of a Prize will be selected in accordance with the dates set out in clause 5.1. The winners of a Prize will be drawn at random on the dates set out in clause 5.1. Entrants should note that when drawing a winner, no regard or consideration will be given by TfGM as to the quality, content or substance of any entry received in accordance with clause 3.3.
3.8 TfGM will not accept:
(a) responsibility for competition entries that are incorrect, damaged or delayed regardless of cause, including, for example, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) responsibility for the entrant failing to comply with any of these terms and conditions, any terms of acceptable website use, guidance and/or other conditions which may apply to any of TfGM’s websites, the Campaign or any other websites relating to the competition.
3.9 By taking part in the competition, you are agreeing to be bound by these terms and conditions and agree to participate in any reasonable publicity as required by TfGM. This includes allowing TfGM permission to re-post any entry received in accordance with clause 3.3 on its social media channels.

4. Eligibility
4.1 The competition is only open to all residents in the UK aged 18 years or over, except:
(a) employees of TfGM, Laing O’Rourke Construction Limited, Volkerrail Limited, Thales Holdings UK PLC, Keolis Amey Metrolink Limited, Dinosaur Ltd, AKA Promotions Limited, SKV Communications Limited or Cube 3 Digital Limited or any of its holding or subsidiary companies;
(b) employees of agents or suppliers of any of the parties set out in clause 4.1(a) who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any Prize you may win. TfGM may require you to provide proof that you are eligible to enter the competition or claim any Prize.
4.3 TfGM will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk;
(c) illegible or have been altered;
(d) contain inappropriate, harmful or otherwise unsuitable usernames;
(e) are not original photographs taken by the entrant or are otherwise owned by a third party; or
(f) incomplete.
4.4 There are no limits of entries for the competition. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.5 TfGM reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
5. The prizes
5.1 The prizes which are available to be won in taking part in the competition (“the Prizes”) are as follows:

5.2 As well as the Prizes set out in clause 5.1 above, all entrants will have the opportunity to have their photograph used by TfGM in connection with the Campaign. TfGM will at its discretion contact any entrants to obtain their permission to use their submitted photograph and to obtain further copies of the any original photograph included in their entry (including high resolution copies as appropriate). For the avoidance of doubt, entrants should note that being contacted by TfGM in accordance with this clause does not automatically entitle them to a Prize.
5.3 In addition to the Prizes, all individuals who collect a Golden Noel will be entitled to travel on the Metrolink on the weekends between 9th November 2019 to 22nd December 2019 free of charge up to the value of a family travelcard (for up to two adults and three children (aged 15 and under). To be eligible, individuals will simply have to present their Golden Noel to a ticket inspector instead of a valid Metrolink ticket(s).
5.4 Prizes are subject to availability. There is no cash alternative for the Prize. TfGM reserves the right to substitute the Prize with a Prize of equal or greater value.
5.5 The Prizes may be supplied by a third party supplier, being the retailer or venue where the Prize may be claimed. TfGM reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond TfGM’s control makes it necessary to do so.
5.6 All Prizes will be allocated at TfGM’s discretion and are not negotiable or transferable.
6. Winner announcement
6.1 Winners of the competition will be announced by TfGM on its social media channels in accordance with the dates set out in clause 5.1 (“__the Announcement Date__”).
6.2 If you are the winner of the prize, you will have seven days from the Announcement Date to claim the Prize by replying to any message received by TfGM or by emailing TfGM at If you do not claim the Prize by this date, your claim will become invalid.
6.3 The Prize may not be claimed by a third party on your behalf.
6.4 TfGM will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their Prize within seven of days of the Announcement Date, TfGM reserves the right to offer the Prize to the next eligible entrant and in doing so will repeat the process set out in clause 3.7.
6.5 Prizes may be subject to expiry dates as may be notified to entrants when winning the Prize. TfGM does not accept any responsibility if an entrant fails to claim the Prize in accordance with clause 6.4.
7. Limitation of liability
7.1 Insofar as is permitted by law, TfGM, its agents or distributors will not in any circumstances be responsible for or accept any liability incurred by an entrant for any loss, damage, personal injury or death incurred as a result of collecting a Noella Figure and/or a Golden Noel, entering into the competition or incurred as a result of taking up or otherwise failing to take up a Prize, except where it is caused by the negligence of TfGM, its agents or distributors or that of their employees. Your statutory rights are not affected.
7.2 Insofar as is permitted by law, your liability to TfGM will be unlimited in respect of any breach of clauses 8.2 and 8.3.
8. Ownership of competition entries and intellectual property rights
8.1 All competition entries and any accompanying material submitted to TfGM will become the property of TfGM on receipt and will not be returned to the entrant.
8.2 By submitting your entry and any accompanying material in accordance with clause 3.3, you agree that TfGM may, but is not required to, use your entry and any photographs or other media in connection with the competition and/or the Campaign. You agree to grant TfGM a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompany materials for such purposes.
8.3 By submitting your entry and any accompanying material in accordance with clause 3.3, you confirm and hereby warrant that:
(a) all photographs, images and other media included in your entry are your original works, are not defamatory and do not infringe any third-party rights;
(b) there are no conflicting agreements in place that restrict usage of any photographs, images or other media;
(c) you have consent to use and distribute any third-party photograph, image or other media used in the entry;
(d) you have the consent to use and distribute any photograph or image of a third-party that may be contained in the entry; and
(e) you will provide evidence of any required consents or licences at the reasonable request of TfGM, failing which you will risk being disqualified from the competition.

10. General
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, TfGM may at its sole discretion, reserve the right to exclude you from participating in the competition.
10.2 TfGM reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
10.3 These terms and conditions (including any non-contractual disputes or claims) shall be governed by the law of England and Wales, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales to settle any dispute and claim arising out of or in connection with it (including any non-contractual disputes or claims).
