Terms and conditions for 18-21 ticket

1. Introduction, scope and exclusions

1.1. The purpose of the 18-21 Entitlement (defined under clause 2) is to give young people access to discounted travel. These terms and conditions (“Terms”) (together with the documents or other items referred to in them) tell you, our customer, how you may apply for and use an 18-21 Entitlement issued by TFGM. When applying for a 18-21 Entitlement you will be deemed to have accepted these Terms.

1.2. Transport for Greater Manchester (“TfGM”), established pursuant to the Transport Act 1968 and the South East Lancashire and North East Cheshire Passenger Transport Area (Designation) Order 1969, is the passenger transport executive for the combined authority area of Greater Manchester. TfGM’s headquarters are at 2 Piccadilly Place, Manchester M1 3BG, and references to “we”, “us” and “our” in these Terms shall be construed accordingly.

1.3. Please note however that these Terms do not cover any conditions of carriage or any terms and conditions that may apply to any relevant transport operators.

1.3.1. The applicable terms and conditions can usually be found on the relevant bus operator’s website or:

1.3.2. in the case of franchised bus services on the bus conditions of carriage webpage; and

1.3.3. in the case of Metrolink on the Metrolink conditions of carriage webpage.

1.4. Please read these Terms carefully before applying for and using your 18-21 Entitlement. It is your responsibility to be familiar with these Terms. The Terms include provisions which limit TfGM’s liability.

1.5. We may refuse to issue or we may withdraw 18-21 Entitlement at our discretion and in accordance with these terms and conditions.

1.6. In accepting these Terms, we may contact you to keep you updated on the 18-21 Entitlement scheme.

2. Eligibility

2.1. You will be eligible to apply for the use of the benefit described under clause 3.1 where you comply with the following criteria (“18-21 Entitlement”):

2.1.1. from 1 September after your 18th birthday (and you will be able to use your 18-21 Entitlement until 31 August after your 21st birthday or if your birthday is on 31 August, until your 21st birthday); and

2.1.2. if you are residing in Greater Manchester.

2.2. If you do not meet the eligibility criteria set out in clause 2.1 then you will not be entitled to apply for or use an 18-21 Entitlement.

2.3. To prove that you meet the eligibility criteria set out in clause 2.1 you will need to provide evidence of your eligibility. This means you will have to upload at least one document for each of the following criteria, both of which must also include your full name:

2.3.1. for proof of age, you must provide a copy of a passport, driving licence, birth or adoption certificate, NHS medical card, biometric residence permit, valid UK ID card, EU/EEA ID card or UFF/GV3 Declaration of identity form; and

2.3.2. for proof of address, you must provide a full or provisional driving license, National Insurance Letter, letter from a government agency as listed from gov.uk, an annual P60 Statement or letter or statement from your bank, building society, utility company, mobile phone provider or HMRC (all of which must be no more than 3 months old from the date of your application).

2.3.3. You will not be eligible for the 18-21 Entitlement if you no longer reside in Greater Manchester.

3. Entitlement

3.1. The 18-21 Entitlement entitles the user to a discounted a 28 – day Bee Bus ticket, subject to the use of a relevant Pass ID (defined under clause 6.1).

4. Registration and Application

4.1. You can apply for a 18-21 Entitlement by using:

4.1.1. the Bee Network App (available to download from the Apple App Store or the Google Play App Store) (“Bee Network App”) which will grant you access to a Pass ID on the Bee Network App; or

4.1.2. by exception via a form which can be obtained at a Bee Network Information and Ticket Office for a Bee Network photocard which will be used as your 18-21 Entitlement. You must comply with the terms and conditions applicable to the smart cards (smart card terms and conditions).

4.2. Please note, to apply for the 18-21 Entitlement through the Bee Network App you must comply with the terms and conditions applicable to the Bee Network App which can be found on the app terms and conditions webpage

4.3. You will be charged a non-refundable administration fee of £10 when applying for a 18-21 Entitlement. This fee will not be refunded if your application is rejected or you no longer want the 18-21 Entitlement.

4.4. You must only apply for a 18-21 Entitlement using one of the application methods set out in clause 4.1. Any application determined (by TfGM in its absolute discretion) to be duplicated across the methods set out will be removed and the fee for the removed application will not be refunded.

4.5. Applications for a 18-21 Entitlement must be made by you as the user and applicant. If TfGM discovers or suspects that any application for a 18-21 Entitlement may have been made on a fraudulent basis, TfGM reserves the following rights:

4.5.1. to pass such evidence to the police;

4.5.2. to suspend and/or disable the 18-21 Entitlement relating to such application; and

4.5.3. to prevent the applicant who made such application to hold a 18-21 Entitlement.

4.6. Before your application can be started, you must register and verify your account as follows:

4.6.1. on the Bee Network App by completing name, address and date of birth details; or

4.6.2. where you complete a paper form, your account will be set up for you and allow you to be sent a link to your account and application on the website if desired. You will be asked to provide an email address.

4.7. Please make sure that you read our Privacy Policy and Cookie Policy so that you are aware of what information (including personal data) we will collect from you when you apply for and use a 18-21 Entitlement and how such information will be treated.

4.8 By completing an application for a 18-21 Entitlement, you confirm that you have authority to use the payment method or account details you provide for the purpose of applying for your 18-21 Entitlement.

4.9. You promise that all information supplied by you in your application and when using your 18-21 Entitlement is accurate.

5. Receiving your 18-21 Entitlement

5.1. If you have applied for the 18-21 Entitlement via the Bee Network App then as set out in the Bee Network App terms and conditions:

5.1.1. you will be able to view the status and progress of your application in the app; and

5.1.2. you will also receive emails to confirm whether your application has been accepted, rejected, or if further actions are required by you.

5.2. Subject to your application being successful, your 18-21 Entitlement will be delivered digitally via the App to your mobile device (“Device”). This will be in the form of a digital Pass ID accessible on the Bee Network app.

5.3. Note that the Pass ID will be accessible once a user signs into their online account on the Bee Network app.

6. Pass ID and using your 18-21 Entitlement

6.1. Upon approval of your application for an 18-21 Entitlement, within the Bee Network App you will have access to a digital pass containing your personal details (“Pass ID”). The Pass ID will entitle you to purchase a discounted a 28 – day Bee Bus ticket.

6.2. The presentation of your Pass ID together with your discounted 28-day Bee Bus ticket might be required by inspectors and/or TfGM representatives when you are travelling on our bus network.

6.4. It is your responsibility to ensure that your Device remains charged – if the Device runs out of battery and cannot be switched on to present your Pass ID and discounted 28-day Bee Bus ticket, we cannot accept responsibility if as a result you are unable to travel or are required to purchase a full price ticket for your journey.

6.5. If you do not have a valid Pass ID and discounted 28-day Bee Bus ticket with you when you travel, you must buy a full price ticket for your journey (or have in your possession another form of valid ticket or pass, entitling you to travel). For clarification, any tickets bought in such circumstances are non-refundable and in the event that you travel without a valid Pass ID and discounted 28-day Bee Bus ticket then you may be liable for a penalty fare.

6.6. You must not allow another person to use your 18-21 Entitlement. Your right to discounted travel is not transferable.

6.7. When using your18-21 Entitlement, you must also comply, and observe the appropriate passenger regulations, conditions of carriage and byelaws applicable to your journey (including those of any relevant third party). We may refuse to make available, or refuse to accept the continued use of, an 18-21 Entitlement if we have reason to suspect that such an 18-21 Entitlement has, or will be, used for fraudulent or improper purposes or not in accordance with these Terms. TfGM reserves the right to block your 18-21 Entitlement in order to make them unusable in such circumstances.

6.8. Your 18-21 Entitlement is valid up to the expiry date shown on the front of it and/or for as long as you continue to be eligible to use your 18-21 Entitlement or until we decide otherwise.

6.9. Your 18-21 Entitlement is not valid for travel. You must purchase a ticket where such ticket covers the journey you are making at that time.

6.10. For the avoidance of doubt, the discounted 28-day Bee Bus ticket does not offer a guaranteed place on any particular route or mode of transport. Seats are allocated on a first come first served basis, or in accordance with the relevant bus operator’s conditions of carriage, or in accordance with the policies of TfGM (as appropriate). 28-day Bee Bus tickets do not guarantee the availability, or the accuracy of any timetabling, of any bus service.

6.11 You will be responsible for ensuring you have the necessary login details (including passwords, emails, and usernames) to access your Bee Network App account, 18-21 Entitlement, and Pass ID.

6.12. The use of your 18-21 Entitlement is also governed by any relevant terms within the Bee Network App terms and conditions (Bee Network app terms and conditions).

  1. Lost and Stolen

7.1. If your photocard holding your 18-21 Entitlement (as described under clause 4.1.1) is lost or stolen, please notify us immediately by contacting Customer Services.

7.2. We may charge an administration fee of £10 for a replacement.

8. Closing your Bee Network App account

8.1. If you wish to delete your Bee Network App account, this can be done in the Bee Network App under account settings.

8.2. If you delete your account you will lose access to your 18-21 Entitlement along with any tickets that you have purchased via the app.

8.3. Note that your data may be retained in line with our data retention policy.

9. Our liability

9.1. Subject to clause 9.4, we will not be liable for losses that result from our failure to comply with these Terms that fall into the following categories:

9.1.1. loss of income or revenue;

9.1.2. loss of business;

9.1.3. loss of profits;

9.1.4. loss of anticipated savings; and/or

9.1.5. waste of management or office time, provided that this clause 9.1 will not prevent claims for loss of or damage to your tangible property that are foreseeable or any other claims for direct loss that are not excluded by clauses 9.1.1 to 9.1.5. For the avoidance of doubt, we shall not be liable for any liability, loss or expense which is attributable to any acts or omissions of any bus operator or any other operator of public transport (acting in their capacity as an operator, for that purpose).

9.2. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control.

9.3. Nothing in these Terms affects your statutory rights or excludes or limits our liability for:

9.3.1. death or personal injury caused by our negligence;

9.3.2. fraud or fraudulent misrepresentation; and/or

9.3.3. any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

10. Written communications

10.1. Applicable laws require that some of the information or communications we send to you should be in writing. Further information about this can be found in our Privacy Policy as set out in clause 4.7. This condition does not affect your statutory rights.

11. Notices

11.1. All notices or communications given by you to us must be given to TfGM at 2 Piccadilly Place, Manchester, M1 3BG, or by email using the following email address: hello@beenetwork.com. We may give notice to you at either the e-mail or postal address you provide to us when you apply for your 18-21 Entitlement.  Notices will be deemed received and properly served immediately when posted on our Website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

12. Transfer of rights and obligations

12.1. Upon applying for a 18-21 Entitlement, these Terms are binding on you and us and on our respective successors and assignees.

12.2 You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations arising under these Terms, without our prior written consent.

12.3. We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these Terms, at any time.

13. Waiver

13.1. If we fail, at any time during the time that these Terms are in force, to insist upon strict performance of any of your obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

13.2. A waiver by us of any default will not constitute a waiver of any subsequent default.

13.3. No waiver by us of any of these Terms will be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 11.

14. Severability

14.1. If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

15. Entire agreement

15.1. We intend to rely upon these Terms and any document expressly referred to in them in relation to their subject matter. Nothing in these Terms affects your statutory rights.

16. Our right to vary these Terms

16.1. We have the right to revise and amend these Terms at our discretion from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

16.2. Revisions or amendments to these Terms will be notified to you by way of marketing materials, emails or such other methods as we shall determine.

16.3. A copy of the most up to date Terms will be available on our Website.

17. Law and jurisdiction

17.1. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), will be governed by English law.  Any dispute or claim arising out of or in connection with these Terms (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
