The Hotspot

The Hotspot is a wireless data service using radio frequency to access the Internet. TfGM offers the Hotspot for activities such as the active use of email, instant messaging, and browsing the Internet. These services may require the User to have accounts with third party service providers. The User may view, use, download and store material on the launch site of the Hotspot for personal use only.

Due to the nature of the service, the User acknowledges that faults, technical difficulties and/or loss of signal may lead to temporary unavailability of the Hotspot and that the operation of the Hotspot may be adversely affected by conditions and performances outside TfGM’s control, including but not limited to transmission, communications links between TfGM and Users, between different parts of TfGM, and between TfGM and other systems and networks.

The User is expressly reminded that the Internet and Wi-Fi connections are not secure networks or a secure way to access the network. In these circumstances, it is the User’s responsibility to take all appropriate measures to protect their own data and/or software, including but not limited to contamination by viruses that may travel over the Internet and/or from third-party intrusion into their device, and to backup their device before and after setting up Wi-Fi access.

Third Party Information

The User further acknowledges that some of the Information on the launch site, for example software, is supplied to TfGM (directly and indirectly) by third parties and accordingly, except to the extent it must do so under law, TfGM offers no warranty of whatever nature in relation to such Information.

TfGM is not responsible for any content of the Internet, including but not limited to web sites, and does not independently verify third party information delivered through the Hotspot. TfGM makes no representation in respect of such information as to its accuracy, and assumes no responsibility for the User’s use of such information and any consequences of that use, including, but not limited to, any damages, injuries or consequences that may result from its use. The User acknowledges that the Information and opinions in the third party information/websites are not endorsed by TfGM.

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any part of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

Use of the Hotspot/Indemnification

The User undertakes and agrees:
- not to use the Hotspot for any unlawful purpose;
- that it shall not make any use of the Hotspot such that the whole or part of the Hotspot is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of the Hotspot is in any way impaired;
- not to use the Hotspot for the transmission or posting of any computer viruses or any other harmful code, or any material which is defamatory, offensive or of an obscene or menacing character or in such a way as to cause annoyance, inconvenience or needless anxiety;
- not to use the Hotspot in a manner which constitutes a violation or infringement of the rights of any person, firm or company (including but not limited to rights of copyright or confidentiality);
- that in the event that it has any right, claim or action against any other user arising out of the use of the Hotspot then it shall pursue such right, claim or action independently of, and without recourse to, TfGM; and
- that TfGM may block access to certain websites by the User on the Hotspots, for example certain high bandwidth web sites in order to share bandwidth more amongst its user group.
- The User will indemnify and defend TfGM against all claims, liability, damages, costs and expenses, including but not limited to legal fees, arising out of a breach of the Terms and Conditions or any Use of the Hotspot by the User and/or against any claims or legal proceedings arising in connection with User's use of the Hotspot which are brought or threatened against TfGM. The User acknowledges that TfGM has no control over the nature or content of information or programs transmitted or received by the User using the Hotspot.

Intellectual Property

The User acknowledges that the Hotspot is owned and operated by TfGM and its licensors. Except as expressly authorised by prior written consent from TfGM, no material from the Hotspot launch site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that the User may download one copy of the materials on any single wireless device for the User’s internal non-commercial use only, provided that the User keeps intact all copyright and other proprietary notices.

Modification of the materials or use of the materials for any other purpose is a violation of TfGM’s copyright and other proprietary rights. For the purpose of these Terms and Conditions, the use of any such material on any other website or networked computer environment is prohibited. Any product, process or technology described in the launch site may be the subject of copyright or other intellectual property rights reserved by TfGM and are not licensed to the User hereunder.

Suspension and Termination

TfGM shall have the right to immediately terminate without notice the User’s use of the Hotspot and/or suspend the availability of the Hotspot if, in TfGM’s sole opinion, the User commits a breach of the Terms and Conditions.

TfGM shall have the right to terminate or suspend the Wi-Fi availability without notice, at any time, at TfGM’s sole discretion.
User Data

“Personal Data” is defined by the Data Protection Act 1998. TfGM will deal with the User’s Personal Data in compliance with the current data protection legislation in England and Wales.

In addition, TfGM will conduct system performance monitoring usage analysis by collecting the following data:
- Volume of data being uploaded and downloaded
- Usage by time of day and location (i.e. which Hotspot)
- Internet sites which are being visited
- Amount of time being spent online
- What devices are used to access the Hotspot
- How many users are connecting to the Wi-Fi signal (split by metrics above) at any one time
- None of the data collected will be directly correlated with the User's name, login ID, the MAC address of their device, or other similar identifying information.

TfGM may contact the User from time to time regarding the free Wi-Fi service. User details will not be passed on to any third parties without the permission of the User.

By using the Hotspot, the User consents to TfGM using their Personal Data in this way.

TfGM cannot guarantee the security or privacy of the Hotspot and any information or communication to or from the Hotspot by the User.

Changes to the Terms and Conditions

TfGM reserves the right to change these Terms and Conditions from time to time by placing a suitable notice of such change on the Hotspot launch site. The User's continued use of the Hotspot following notice of such change shall be deemed to be the User's acceptance of any such change. It is the User's responsibility to check the Hotspot launch site regularly to determine whether the Terms and Conditions have been changed. If the User does not agree to any change to the Terms and Conditions then the User must immediately stop using the Hotspot.

Each provision of the Terms and Conditions excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held inapplicable or unenforceable in any circumstances and shall remain in force notwithstanding the cessation of the User’s use of the Hotspot.

No Waiver

No waiver by TfGM shall be construed as a waiver of any breach of any provision of the Terms and Conditions.
Choice of Law

The Terms and Conditions shall be governed by English law and the parties hereby irrecoverably submit to the exclusive jurisdiction of the Courts of England and Wales.
